INAPLICABLE EL DERECHO DE GRACIA A OTORGADA A FUJIMORI.- La Sala Penal Transitoria de la Corte Suprema de Justicia confirmó la resolución que declaraba inaplicable el derecho de gracia otorgado al exmandatario Alberto Fujimori, por lo que dispuso que el proceso seguido por el Caso Pativilca continúe su curso.
Durante el gobierno del entonces Pedro Pablo Kuczynski (PPK) otorgó en el 2017, un indulto humanitario y gracia presidencial para Fujimori como parte de una negociación política. Pues como bien se recuerda, el indulto a Fujimori se da en el marco de un inesperado apoyo del excongresista Kenyi Fujimori para evitar la vacancia presidencial. Un indulto política y jurídicamente cuestionado.
Al conceder el indulto, Fujimori había quedado sustraído de los procesos en curso como el de Pativilca, en donde es sindicado como autor mediato del asesinato de seis campesinos perpetrado por el Grupo Colina, por lo que la fiscalía ha solicitado 25 años de prisión.
En los considerandos, la sala —que preside el magistrado Víctor Prado Saldarriaga— refiere que la gracia presidencial “aun cuando es una prerrogativa constitucional otorgada al presidente de la República, no es un acto discrecional que no pueda ser objeto de control”. Entre los argumentos esta el hecho del cómputo del plazo de la investigación. “Solo puede computarse el plazo para conceder la gracia presidencial desde que la Corte Suprema de Justicia de Chile accedió al pedido de ampliación de extradición [por el Caso Pativilca] […], esto es, desde el 5 de junio del 2017”, se lee en la resolución a la que accedió a El Comercio.
La Sala Penal Transitoria, finalmente resolvió “admitir el cómputo del plazo desde una fecha anterior significaría incumplir” el tratado de extradición suscrito con
