Tras la controversia jurídica suscitada con la muerte del líder de sendero luminoso, sanguinario y genocida Abimael Guzmán Reynoso, y del peligro que constituiría la entrega de su cadáver, para la seguridad nacional, el Congreso de la República aprobó la modificación de la Ley  26842, Ley General de Salud,  incorporando el artículo 112-A:

“ARTÍCULO 112-A.- EN EL CASO DEL CADÁVER DE UN INTERNO QUE VENÍA CUMPLIENDO CONDENA CON SENTENCIA FIRME POR LOS DELITOS DE TRAICIÓN A LA PATRIA O DE TERRORISMO, EN SU CONDICIÓN DE LÍDER, CABECILLA O INTEGRANTE DE LA CÚPULA DE ORGANIZACIONES TERRORISTAS, CUYA ENTREGA, TRASLADO, SEPELIO O INHUMACIÓN PONGA EN RIESGO LA SEGURIDAD NACIONAL O EL ORDEN INTERNO, EL FISCAL COMPETENTE, EN DECISIÓN MOTIVADA E INIMPUGNABLE, DISPONE SU CREMACIÓN, PREVIA NECROPSIA.

LA AUTORIDAD SANITARIA, EN COORDINACIÓN CON EL MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS Y EL MINISTERIO DEL INTERIOR, EJECUTA LO DISPUESTO EN UN PLAZO MÁXIMO DE VEINTICUATRO (24) HORAS. LA CREMACIÓN SE REALIZA EN PRESENCIA DE UN REPRESENTANTE DEL MINISTERIO PÚBLICO, PARA FINES DE IDENTIFICACIÓN, QUIEN LEVANTA EL ACTA CORRESPONDIENTE.

EL MINISTERIO DE JUSTICIA Y DERECHOS HUMANOS DISPONE LA DISPERSIÓN DE LOS RESTOS CREMADOS EN TIEMPO Y LUGAR DE NATURALEZA RESERVADA. EN SU EJECUCIÓN CONTARÁ CON EL APOYO DEL MINISTERIO DEL INTERIOR”.

El Ejecutivo, promulgó la Ley y con ello se zanja la controversia jurídica suscita por vacíos en la ley interna.

Gobierno promulga la Ley N° 31352 que incorpora el artículo 112-A a la Ley 26842, Ley General de Salud, a fin de establecer el destino de cadáveres de internos que venían cumpliendo condena por los delitos de traición a la patria o de terrorismo.
